PROVIDE DAILY SUPPORT FOR STUDENTS.

All UESF Union Building Committees are encouraged to send a
representative to the UBC training on Wednesday, January 30th.

Titled, "How to Think, Listen, and Act Like a Building Rep: Meeting
with Your Principal" the training is an opportunity to expand your
knowledge of the contract and the grievance process. The training also
includes an advanced guide on how to best represent UESF employees in
grievance meetings with your principal.

UESF members on new UBCs are especially encouraged to attend. However,
seasoned veterans will also greatly benefit from the advanced portions
of the training.

decision on SFUSD schools. This will be a hands-on workshop that will
prepare you for enforcing your UESF contract at your school site.

Question: My principal just established a 'Leadership Team' at my
school.
What should I expect from this new team? What are my rights?
Answer: 'Leadership Teams' are
entirely a creature of the district,
the duties and responsibilities of
which were never bargained with
UESF. What we have seen so far
is that 'Leadership Teams' have
been established to advise the
principal on various areas including
curriculum, student assessment,
and grant implementation.
Many members have contacted
UESF, concerned that 'Leadership
Teams' are doing more than
advising – they are acting as
quasi-management, decision-making
bodies. If so, then we have a
problem.
Because the establishment of
the 'Leadership Teams' was not
bargained with UESF, they have
no authority to determine any
changes in working conditions.
Furthermore, a 'Leadership Team'
can in no way usurp the rights of
the Union Building Committee.
We have also received some
reports that Leadership Teams are
composed of hand-picked staff,
with the obvious intention of
undermining the UBC. This is a
serious violation of the
UESF/SFUSD contract.
Some important things to
remember when considering a
'Leadership Team' if one has been
established at your school site:
• You have the right to refuse to
participate in a 'Leadership
Team.' You cannot be negatively
evaluated if you choose not
to be on a 'Leadership Team.'
• The Union Building Committee
and the Building Representative
are the representatives of UESF
at the school site. Under the
contract, principals are
required to share information
and ideas with the goal of
achieving consensus on site
operations and policy, including
staffing, assignment, programming,
facilities management
and planning, staff development,
and budgeting (Article
25.3.7).
• 'Leadership Teams' can discuss
any issues they please, but they
cannot make decisions outside
of a narrow range of items that
are completely under the
purview of the principal. The
Union Building Committee
must be consulted if any site
operations or policy changes at
the school are to be considered.
• Members of a 'Leadership
Team' have no authority at the
school site. They are in no way
supervisors or evaluators of
others' work.
• New meetings and meeting
times must be scheduled with
the concurrence of the UBC
(Article 7.2.7)
• Leadership teams can't implement
proposed district policy
at the site level. Any new district
initiatives or proposals
must go through the UBC.
• UESF suggests that 'Leadership
Team' reports be made at
monthly UBC/administration
meetings.
If a 'Leadership Team' has
overstepped its advisory role, it is
important that you bring the
matter up with your Building
Representative, and discuss the
issue with your UBC. If you are
concerned that your 'Leadership
Team' has been established with
the intention of undermining
your UBC or Building
Representative, contact UESF
immediately at 956-8373.
UESF Requests More Information on
District "Equitable Education for all
Middle School Students" Proposal
On November 13, 2007 UESF
President Dennis Kelly sent a letter to
Joan Hepperly, the SFUSD Assistant
Superintendent of Middle Schools,
seeking more information on the new
district proposal, "Equitable Education
for all Middle Schools."
The proposal includes the establishment
of a seventh period as a pilot program
in a few middle schools.
However, it was unclear whether the
extra period would be established for
the purpose of adding another numeracy
or literacy section or whether electives
would be added.
UESF is very much interested in making
middle schools more successful
institutions for learning. However, if
proposed reforms support more 'drilland-
kill' approaches, UESF cannot support
such measures.
Of course, any lengthening of the
school day is a mandatory subject of bargaining,
and therefore cannot be unilaterally
implemented by the district. If you
have any concerns about such a program,
please attend the next Middle
School Committee meeting, or contact
UESF Middle School representative Allan
Brill at abrill@uesf.org. At press time
President Kelly's letter had received no
response.
Principal's Expectations Cannot Be
Used in the Evaluation Process
According to the UESF contract only the
California Standards for the Teaching
Profession can be used during teacher
evaluations. However, some SFUSD principals
have informed their staff that they
will use their Principal Expectations during
the evaluation process.
This is a clear violation of the contract,
and represents a unilateral change in the
conditions of work. If your principal has
indicated that he wishes to use Principal
Expectations during your next evaluation,
contact UESF immediately at 956-
8373.
Paraprofessionals – Remember to
Use your Paid Family Leave Benefit
In 2002, with the help of the labor
movement, the Paid Family Leave (PFL)
Law was enacted in California. PFL provides
workers with a maximum of six
weeks of partial pay each year while taking
time off from work to bond with a
newborn baby, newly adopted or foster
child, or to care for a seriously ill parent,
child, spouse, or registered domestic
partner.
Paraprofessionals and other workers
who pay into the State Disability
Insurance (SDI) Program are eligible for
this benefit. SFUSD teachers do not pay
into SDI and are therefore not eligible.
PFL benefits will replace approximately
55% of wages up to a maximum of
$882.
The PFL program is 100% employeefunded,
and is currently over-funded,
meaning that people who are entitled to
the benefit are not taking advantage of
the program.
Certain conditions apply. Go to the
UESF website at www.uesf.org, and click
on 'Forms and Documents' for a link to
the claim form and more information
about the program. Additional forms are
also available at the UESF office.

How to Think, Listen, and Act Like a Building Rep: Meeting with Your
Principal

All UESF Union Building Committees are encouraged to send a
representative to the UBC training on Wednesday, January 30th.

Titled, ÒHow to Think, Listen, and Act Like a Building Rep: Meeting
with Your PrincipalÓ the training is an opportunity to expand your
knowledge of the contract and the grievance process. The training also
includes an advanced guide on how to best represent UESF employees in
grievance meetings with your principal.

UESF members on new UBCs are especially encouraged to attend. However,
seasoned veterans will also greatly benefit from the advanced portions
of the training.

Note: A full dinner will be served. To ensure your spot, please RSVP to

VALLEY. AS THE UBC HAS BEEN REQUESTING ,WE ALSO NEED TO PROVIDED
EMERGENCY PREPAREDNESS TRAINING FOR STAFF AT OUR SITE. OPTIONS HAVE
BEEN DISCUSSED USING BANKED MINUTES. 24O MINUTES NEEDED FOR A FULL
DAYIN ORDER TO RELEASE STUDENTS. FULL DAY OF STAFF DEVELOPMENT, PAID
RELEASE DAYS FOR FACULTY TO BE TRAINED, PROVIDING STAFF WITH STIPENDS.
J.GALGANO: THIS TRAINING NEEDS TO BE PROVIDIDED BY TRAINED PERSONNEL
SUCH AS THE POLICE OFFICER WHO PROVIDED OUR PREVIOUS SESSION., NOT THE
PEP TALKS AND RUSH THROUGH OF INFORMATION BUT REAL TRAINING.IN READING
THE EDCODE LAWS IT IS CLEARLY STATED OUR SITEÕS SAFETY PLAN WHICH
INCLUDES SCHOOL SAFETY AND EMERGENCY PREPAREDNESS, CLEARLY SPELLS OUT

AND ALL STAFF SHOW UP TO TRAIN,SO ALL STAFF ARE ABLE TO PARTICIAPTE IN

SUPPOSED TO HAVE BEEN COMMUNICATED TO THE STAFF BY THE PRINCIPAL, BUT
IT NEVER HAS BEEN. ON THE JANUARY CALENDAR THIS WILL BE PLACED TO
REMIND STAFF. WE HAVE RECEIVED CONCERNS FROM FACULTY THAT IT IS BEING
REQUIRED AND THEY FEEL THEY HAVE TO PARTICIAPTE. ALSO PROFESSIONAL
DEVELOPMENT ACCORDING TO OUER CONTRACT AND THE SITE PLAN IS A SHARED
DECISION MAKING PROCESS , WHICH NEEDS TO BE RESOLVED THROUGH THIS
MEETING THIS HAS NOT BEEN DONE IN IS A CONCERN

M.HARPER:WHILE I AGREE IN PRINCIPLE I MUST STATE THAT GEAR UP IS
WORKING FOR THE 6TH GRADE, AND MR. CHO WANTS TO PROVIDE TRAINING FOR
TEACHERS THAT WILL HELP STUDENTS, BUT I I WILL COMMUNICATE THIS TO MR
CHO.

A.BROWN: THE INSTRUCTIONAL DEVELOPMENT STRATEGIES IDEA IS SOMETHING
WHICH SHOULD INCLUDE ALL STAFF AND BE DISCUSSED DURING DEPARTMENT AND
GRADE LEVEL MEETINGS , NOT JUST THROUGH GEAR UP.

M.HARPER: MS BROWN I UNDERSTAND YOUR CONCERN AND WILL COMMUNICATE IT TO
MR. CHO.

J.GALGANO: MR HARPER ANOTHER CONCERN IS WHAT HAPPENED THIS WEEK WITH
THE PRINCIPALÕS UNILATERAL DECISION TO CALL IN SUBSTITUTES , THREE
DAYS THIS WEEK FOR PROFESSIONAL DEVELOPMENT NO STAFF WERE INFORMED OF
AHEAD OF TIME, THE UBC WAS NOT INFORMED OF NOR WAS THE TOPIC DISCUSSED
WITH US REGARDING THIS . THESE FUNDS ALSO REQUIRED SSC APPROVAL BUT IT
WAS NEVER COMMUNICATED TO THE SSC NOR APPROVED. MANY OF THESE SUBS
SPENT MOST OF THE DAY IN THE FACULTY LOUNGE OR WANDERED THE HALLWAYS
ACCORDING TO CERTIFICATED AND CLASSIFIED STAFF DURING THIS TIME, NOT A
VERY COST EFFFECTIVE USE OF OUR SITES FUNDS. I AM VERY CONCERNED ABOUT
THE EXPENDITURE OF OUR SITE FUNDS IN THIS WAY, ESPECIALLY SINCE ONE
MATH TEACHER REQUESTED PREVIOUSLY TO BE PROVIDED FUNDS TO ATTEND A MATH
SEMINAR FOR THREE DAYS WHICH WOULD HAVE BENEFITED ALL MATH TEACHERS ,
BUT WAS REFUSED THIS BY THE PRINCIPAL ,WHO STATED TO THEM THAT THERE
WERE NO FUNDS AVAILABLE TO ALLOW HIM TO DO THIS. WHAT WE HAVE HEARD
FROM SITE MGMT IS THAT WE NEEDED TO EXPEND THESE MONIES OR LOSE THEM
,THUS TO PROVIDE NERT TRAINING WE DID THIS. BUT NO FACULTY WERE EVER
INFORMED AHEAD OF TIME , AND COULD NOT ATTEND BECAUSE THEIR CURRICULA
HAD ALREADY BEEN PLANNED TO DO OTHER REQUIRED LESSONS.


M.HARPER:MR GALGANO I APPRECIATE YOUR CONCERN AND CAN ONLY REPLY I HAVE
NO DEFENSE FOR THE REQUEST AND USE OF THESE SUBS , TO PROVIDE COVERAGE
FOR NERT TRAING OF FACULTY. WE WERE NOT SURE THEY WOULD COME . WHEN THE
REQUEST WAS MADE WE WERE NOT SURE THE DISTRICT WOULD APPROVE THESE
FUNDS . BUT NERT TRAINING WAS DONE PARTIALLY WITH SOME STAFF DURUING
THIS TIME WITH A FEW TEACHERS.

THIS UNILATERAL EXPENDITURE ,WHICH SHOULD HAVE BEEN USED TO ALLOW
TEACHERS TO ATTEND PROFESSIONAL DEVELOPMENT FOR WHAT MGMT IS REQUESTING
US TO DO ON FEBRUARY 8TH.

M.HARPER: I AGREE THE DECISION WAS MADE WITHOUT USING THE SHARED
DECISION PROCESS

J.GALGANO: ANOTHER CONCERN WE HAVE SITE MGMTÕS CALLING TODAY FOR ,THIS
ODD CLASS SCHEDULE WE WERE NEVER INFORMED, THAT WOULD LEAD US TO GO TO
AN ASSEMBLY THROUGOUT THE SCHOOL DAY, PULLING OUR TEACHERS AND STUDENTS
FROM ACTIVITIES THAT HAVE BEEN PLANNNED. AS FAR AS WE KNEW AND WERE
PREPARED FOR WE WOULD BRING STUDENTS DURING 7TH PERIOD FOR PE TEACHER
PLANNED EVENTS. INSTEAD WE RECEIVED A MEMO IN OUR BOX THIS MORNING FOR
A SCHEDULE THAT WOULD DISRUPT OUR WHOLE SCHOOL DAY TO COVER OTHER
ACTIVITIES AND CONCERNS. ONCE AGAIN THIS WAS NEVER COMMUNICATED PRIOR
TO THIS TO FACULTY OR THE UBC AND ALL OF THIS HAS CREATED A LOT OF
CONCERN AND TENSION BY ITS OCCURRENCE.

M.HARPER: I AGREE THIS WAS NOT DONE THROUGH THE SHARED DECISION MAKING
PROCESS , BUT A SERIOUS INCIDENT OCCURRED WHICH ALL OF YOU MAY OR MAY
NOT HAVE HEARD ABOUT , BUT WHICH I CANNOT INFORM YOU OF WHICH WE FELT
NEEDED TO BE DEALT WITH.

J.GERBER: THIS IS NOT A GOOD TIME TO COVER THESE SERIOUS ISSUES WHICH
I AM NOT REALLY FULLY AWARE OF, WE ARE CELEBRATING THE END OF THE YEAR
AND IT IS A DAY BEFORE STUDENTS LEAVE FOR VACATION.WE SHOULD NOT HAVE A
SERIOUS CONCERN OF SUCH MATTERS AT THIS TIME. THIS IS NOT A TIME FOR A
SERIOUS CONVERSATION FOR WHATEVER HAPPENED.
M.HARPER: I AGREE THIS DECISION WAS NOT SHARED , BUT SINCE MR CHO IS
NOT HERE , I AM WILLING TO DO WHAT IS EVER REQUESTED TO RESOLVE THIS
MATTER. BUT I MUST TELL YOU THIS SCHEDULE WAS DEVELOPED TO DEAL WITH
SERIOUS MATTERS I AM UNABLE TO DISCUSS, BUT WHEN YOU ARE INFORMED ABOUT

COMPLAIN TO US. ALSO THE WAY I READ IT IT DISRUPTS ALL TEACHERS PLANNED
SCHEDULES AND PLANNED LESSONS AND DOES NOT INCLUDE PREP TIME SCHEDULES
FOR TEACHERS.

M.HARPER: IF YOU WILL LOOK AT THE SCHEDULE , IT DOES PROVIDE FOR
TEACHER PREP TIMES.

J.SHELDON: I DO NOT AGREE WITH THAT IN REGARDS TO MY STUDENTS. I AM
SHORT STAFF AND WILL BE UNABLE TO HAVE A LUNCH OR PREP PERIOD WITH THIS
SCHEDULE. THE TIMES STATED ON THIS SHEET DO NOT COINCIDE WITH PREP
PERIODS AS I READ IT.

M.HARPER: I AM WILLING TO AGREE TO DEAL WITH THIS MATTER REGARDING ALL

IT NEVER HAS BEEN. ON THE JANUARY CALENDAR THIS WILL BE PLACED TO
REMIND STAFF. WE HAVE RECEIVED CONCERNS FROM FACULTY THAT IT IS BEING
REQUIRED AND THEY FEEL THEY HAVE TO PARTICIAPTE. ALSO PROFESSIONAL
DEVELOPMENT ACCORDING TO OUER CONTRACT AND THE SITE PLAN IS A SHARED
DECISION MAKING PROCESS , WHICH NEEDS TO BE RESOLVED THROUGH THIS
MEETING THIS HAS NOT BEEN DONE IN IS A CONCERN

M.HARPER:WHILE I AGREE IN PRINCIPLE I MUST STATE THAT GEAR UP IS
WORKING FOR THE 6TH GRADE, AND MR. CHO WANTS TO PROVIDE TRAINING FOR
TEACHERS THAT WILL HELP STUDENTS, BUT I I WILL COMMUNICATE THIS TO MR
CHO.

A.BROWN: THE INSTRUCTIONAL DEVELOPMENT STRATEGIES IDEA IS SOMETHING
WHICH SHOULD INCLUDE ALL STAFF AND BE DISCUSSED DURING DEPARTMENT AND
GRADE LEVEL MEETINGS , NOT JUST THROUGH GEAR UP.

J.GALGANO: MR HARPER ANOTHER CONCERN IS WHAT HAPPENED THIS WEEK WITH
THE PRINCIPALÕS UNILATERAL DECISION TO CALL IN SUBSTITUTES , THREE
DAYS THIS WEEK FOR PROFESSIONAL DEVELOPMENT NO STAFF WERE INFORMED OF
AHEAD OF TIME, THE UBC WAS NOT INFORMED OF NOR WAS THE TOPIC DISCUSSED
WITH US REGARDING THIS . THESE FUNDS ALSO REQUIRED SSC APPROVAL BUT IT
WAS NEVER COMMUNICATED TO THE SSC NOR APPROVED. MANY OF THESE SUBS
SPENT MOST OF THE DAY IN THE FACULTY LOUNGE OR WANDERED THE HALLWAYS
ACCORDING TO CERTIFICATED AND CLASSIFIED STAFF DURING THIS TIME, NOT A
VERY COST EFFFECTIVE USE OF OUR SITES FUNDS. I AM VERY CONCERNED ABOUT
THE EXPENDITURE OF OUR SITE FUNDS IN THIS WAY, ESPECIALLY SINCE ONE
MATH TEACHER REQUESTED PREVIOUSLY TO BE PROVIDED FUNDS TO ATTEND A MATH
SEMINAR FOR THREE DAYS WHICH WOULD HAVE BENEFITED ALL MATH TEACHERS ,
BUT WAS REFUSED THIS BY THE PRINCIPAL ,WHO STATED TO THEM THAT THERE
WERE NO FUNDS AVAILABLE TO ALLOW HIM TO DO THIS. WHAT WE HAVE HEARD
FROM SITE MGMT IS THAT WE NEEDED TO EXPEND THESE MONIES OR LOSE THEM
,THUS TO PROVIDE NERT TRAINING WE DID THIS. BUT NO FACULTY WERE EVER
INFORMED AHEAD OF TIME , AND COULD NOT ATTEND BECAUSE THEIR CURRICULA
HAD ALREADY BEEN PLANNED TO DO OTHER REQUIRED LESSONS.

NO DEFENSE FOR THE REQUEST AND USE OF THESE SUBS , TO PROVIDE COVERAGE

A SCHEDULE THAT WOULD DISRUPT OUR WHOLE SCHOOL DAY TO COVER OTHER
ACTIVITIES AND CONCERNS. ONCE AGAIN THIS WAS NEVER COMMUNICATED PRIOR
TO THIS TO FACULTY OR THE UBC AND ALL OF THIS HAS CREATED A LOT OF
CONCERN AND TENSION BY ITS OCCURRENCE.

NO CHILD LEFT BEHIND REQUIREMENTS. THIS WAS NOT DONE AT THE BEGINNING
LAST JANUARY , AND THIS WAS COMMUNICATED TO MR CHO AND IT WAS ALSO
COMMUNICATED TO YOU AND MR CHO AT A FACULTY MEETING AND PREVIOUS
UBC/ADM MEETING. WE MUST RESOLVE THIS MATTER BEFORE THE NEW SEMESTER
BEGINS. TEACHERS DO NOT WANT TO GET LETTERS HOME REGARDING THIS AGAIN.
WE ALSO NEED YOU AND MR CHO TO REVIEW THE SCHOOL DISCIPLINE PLAN THE
FACULTY/UBC DEVELOPED AND APPROVED SO WE CAN ALL BE ON THE SAME PAGE
REGARDING ITS ENFORCEMENT AND THE IN HOUSE SUPSENSION ROOM AND OUR
UPCOMING DETENTION ROOM POLICY MUST BE DISCUSSED AND RESOLVED. I WANT

UESF Requests More Information on
District ÒEquitable Education for all
Middle School StudentsÓ Proposal
On November 13, 2007 UESF
President Dennis Kelly sent a letter to
Joan Hepperly, the SFUSD Assistant
Superintendent of Middle Schools,
seeking more information on the new
district proposal, ÒEquitable Education
for all Middle Schools.Ó
The proposal includes the establishment
of a seventh period as a pilot program
in a few middle schools.
However, it was unclear whether the
extra period would be established for
the purpose of adding another numeracy
or literacy section or whether electives
would be added.
UESF is very much interested in making
middle schools more successful
institutions for learning. However, if
proposed reforms support more Ôdrilland-
killÕ approaches, UESF cannot support
such measures.
Of course, any lengthening of the
school day is a mandatory subject of bargaining,
and therefore cannot be unilaterally
implemented by the district. If you
have any concerns about such a program,
please attend the next Middle
School Committee meeting, or contact
UESF Middle School representative Allan
Brill at abrill@uesf.org. At press time
President KellyÕs letter had received no
response.
PrincipalÕs Expectations Cannot Be
Used in the Evaluation Process
According to the UESF contract only the
California Standards for the Teaching
Profession can be used during teacher
evaluations. However, some SFUSD
principals have informed their staff
that they will use their Principal Expectations
during the evaluation process.
This is a clear violation of the contract,
and represents a unilateral change in the
conditions of work. If your principal has
indicated that he wishes to use Principal
Expectations during your next evaluation,
contact UESF immediately at 956-8373.

Paraprofessionals Ð Remember to
Use your Paid Family Leave Benefit
In 2002, with the help of the labor
movement, the Paid Family Leave (PFL)
Law was enacted in California. PFL provides
workers with a maximum of six
weeks of partial pay each year while taking
time off from work to bond with a
newborn baby, newly adopted or foster
child, or to care for a seriously ill parent,
child, spouse, or registered domestic
partner.
Paraprofessionals and other workers
who pay into the State Disability
Insurance (SDI) Program are eligible for
this benefit. SFUSD teachers do not pay
into SDI and are therefore not eligible.
PFL benefits will replace approximately
55% of wages up to a maximum of
$882.
The PFL program is 100% employeefunded,
and is currently over-funded,
meaning that people who are entitled to
the benefit are not taking advantage of
the program.
Certain conditions apply. Go to the
UESF website at www.uesf.org, and click
on ÔForms and DocumentsÕ for a link to
the claim form and more information
about the program. Additional forms are
also available at the UESF office.
QEIA Trainings - January 7th & 9th
UESF is working with the district to set
up two QEIA trainings on January 7th
for Elementary Schools and January 9th
for Middle and High Schools.
The trainings will be conducted by
CTA staff and will cover the ins-and-outs
of how your school can successfully prepare
for full implementation next year.
If you are at a QEIA school, and are
interested in attending the training, talk
to your Building Representative or call
UESF at 956-8373. Look for details
about the times and locations of the
meetings the first week back at school.
