CONTRADICTED OUR CURRENT POLICY AND HOW THOSE WHO VIOLATE THE UNIFORM
POLICY CANNOT BE PENALIZED
E. REACTION FROM SFUSD IS SIMILAR TO THEIR OVERREACTING ON REQUIRING
SPECIAL ED TEACHERS IN MIDDLE SCHOOLS TO DO ITPÕS EVEN THOUGH THEY ARE
NOT REQUIRED TO AGE 16.
F. MANY FACULTY COMPLAINT THAT THE UNIFORM POLICY WOULD HAVE NO TEETH
AND BE UNENFORCEABLE
G. PARENTS USED TO HAVE TO SIGN CONTRACT ON FOLLOWING THIS UNIFORM
RULE, IT IS NO LONGER DONE AND NOTHING TO REQUIRE THEM TO DO THIS
H. GERBER:THIS UNDERMINES DISPLINE . IT SHOULD BE PART OF THE SITE PLAN
POLICY
I. MCCACHREN: THE UNIFORM POLICY CAME FROM THE PARENTS. PARENTS WANTED
IT THEN AND STILL DO
J. GALGANO: ACCORDING TO EDCODE DEVELOPING A UNIFORM POLICY IS THE
RESPONSIBILITY OF THE SSC AND SHOULD BE PLACED IN THE SITE PLAN TO MAKE
IT BINDING.
K. REYNOLDS/GONZALEZ: THIS WAS A SITE DECISION MADE THROUGH THE PTSA
AND FACULTY AT THE SCHOOL SITE. IF WE ARE NOT GOING TO BE ABLE TO
ENFORC THIS WHY SHOULD WE BOTHER
L. GERBER: IF THE UNIFORM POLICY IS NOT GOING TO BE TAKEN SERIOUSLY OR
WE WILL NOT BE ABLE TO ENFORCE IT, THEN WE NEED TO DROP THE UNIFORM WE
NEED TO DISCUSS ON HOW TO RESOLVE THIS PROPOSAL SO IT IS ENFORCED

UNIFORMS
N. GALGANO: OUR AGREED UPON UNIFORM POLICY IS RELATIVELY THE SAME.
RIGHT NOW AS IT READS BLACK PANTS/SKIRTS AND WHITE SHIRTS AND BLOUSES
ARE REQUIRED. RED SWEATERS, HOODIES AND RED PULL OVERS ARE THE ONLY
OTHER COVERINGS PERMITTED. THE ONLY THING THAT HAS CHANGED IS THE
ENFORCEMENT AND CONSEQUENCES OF INFRACTIONS REGARDING THIS POLICY. I
HAVE TO AGREE WITH OTHER FACULTY IF WE ARE NOT GOING TO BE ALLOWED TO
ENFORCE THIS POLICY THEN WE SHOULD NOT HAVE A UNIFORM POLICY
O. GALGANO: THE UBC AND FACULTY CONTINUE TO ALMOST UNANIMOUSLY SUPPORT
AN IN SCHOOL SUSPENSION ROOM WITHOUT COUNSELORS. THE ADM IS PROPOSING
THEY STAFF IT OR SOMETHING LIKE IT 2 PERIODS A DAY .THIS SHOULD NOT
TAKE PEOPLE AWAY FROM THEIR REGULAR DUTIES . INSCHOOL
SUSPENSION/DETENTION OR CONSEQUENCE ROOM AS WE AGREED SHOULD NOT BE IN
THE COUNSELLING ROOM
P. SHELDON: SALZMAN SAID THAT HIS PROGRAM WOULD BE UNENFORCEABLE
WITHOUT AN IN SCHOOL SUSPENSION ROOM. THE ADM DOES NOT AGREE THAT IT IS
NEEDED OR TO DATE UNABLE TO IMPLEMENT ONE AND IT IS FEBRUARY ALREADY.
Q. GALGANO: MR WILSON CONTINUES TO NEED YOUR HELP TO BE RETURNED TO OUR
SITE PLEASE WRITE NEW LETTERS TO THE SCHOOL BOARD AND SIGN THE PETITION
IN SUPPORT OF HIS BEING RETURNED TO OUR SITE. WE ALSO MAY NEED TO GO
BEFORE THE SCHOOL BOARD TO SPEAK ON MR WILSONÕS BEHALF.PLEASE REMEMBER

DOCTORÕS SLIP.
********Rainy Day Fund Could Mean $30 Million for SF Schools
====================================================
Today Mayor Gavin Newsom announced his support for giving the SFUSD up
to $30 million from the cityÕs rainy day fund to offset the severe
education budget cuts proposed by Governor Schwarzenegger. The fund,
established in 2003 thanks to Supervisor Tom Ammiano, requires the city
to save a certain percentage of its revenue during good economic times.
It currently holds about $122 million, 25% of which can go to schools.

Superintendent Garcia has informed UESF that because of the budget
crisis, the district was anticipating sending out up to 500 layoff
notices. By law, these must be sent out by March 15th. However, the
mayor has pledged to work with the Board of Supervisors to avoid having
to send out the layoff notices.

In the event that layoff notices are sent out, we will make sure that
all contractual rights are enforced. Look for further information in the
coming days and weeks.

I would like to personally thank Supervisor Ammiano and Mayor Newsom for
their support of San FranciscoÕs public schools. The rainy day fund is
an example of what is meant by ÒSan Francisco Values,Ó taking care of
one another with foresight and compassion.

The fund can be accessed if the district receives less
inflation-adjusted per pupil funding from the state and if there would
otherwise be significant teacher layoffs. With the Governor announcing
up to $4.8 billion in education cuts across California, SFUSD is facing
a potential $40 million shortfall and now qualifies for the money.

UBC Training: Health & Safety Ð February 13

prepare you for enforcing your UESF contract at your school site.

activists are invited to attend the training.

> As an employee who is represented by United Educators of San
> Francisco, you have rights that you would not otherwise have. Below we
> will feature many of the rights from which you benefit because you're
> represented by UESF. We will add to this page as needed and requested.
> Please send your suggestions and questions to our webmaster.
>
> Workers' Comp: Protect rights to use your own doctor
> You have the right to use your own doctor immediately if you are
> injured on the job AND if you have filed a request with Benefits and
> Deduction. People who do not have such a form on record, must use the
> Workers Compensation medical facilities at San Francisco General, etc.
> for at least the first thirty days of treatment.
>
> Your letter to the SFUSD should state simply that you wish your doctor
> (name the person or health plan) to be your primary care provider in
> the event of a work-related injury. Deliver that letter to the
> Benefits and Deductions office of the SFUSD. Keep a date stamped copy
> for your records.
>
> Contract Concerns
>
> Seniority is key in para layoff procedure
>
> Sick Leave: Can your administrator put restrictions on your use of
> sick days or personal business days? Simply, NOT!
>
> We do not condone sick leave abuse, but no one can require a note from
> your doctor or your mother for a single day's absence. If your
> administrator makes such a demand, contact your Building Rep or the
> union office immediately.
>
> Five period workday: Full-time secondary teachers teach five periods
> and get one paid preparation period. Some teachers, particularly those
> at small high schools and those who teach special education day
> classes, have typically worked one of the five periods as counselors.
> If you teach in this situation, you should see your name as the
> "counselor" on the attendance sheets. If you are the counselor of
> record, your schedule should include a period for counselling.
>
> Employees' Rights to Representation in a Meeting: Weingarten
>
> If you have reason to believe that a meeting with your administrator
> will result in discipline, you have the right to have a union
> representative at that meeting. You must request to have your
> representative present because your administrator doesn't have to
> inform you of that right.
>
> If your administrator insists you meet without a representative, you
> must attend that meeting, but do not have to answer any questions. You
> cannot legally be disciplined for refusing to answer questions when
> you requested a union representative but were not allowed one. In such
> an instance, it is best to have put your request in writing.
>
> This right to have a union representative present in such meetings was
> established by the Supreme Court in the Weingarten case.
>
> Public Employees' Rights to Due Process: Skelly
>
> Public employees have due process protections on the job, as
> determined by the California Supreme Court. The result of rulings in
> the Skelly case, these are referred to as your Skelly rights.
>
> Public employees are entitled to a "pre-disciplinary hearing." An
> employee must be given a written notice of proposed disciplinary
> action. The notice must include:
> ¥ a statement of the nature of the proposed discipline
>
> ¥ the effective date of the proposed discipline
>
> ¥ the reasons for the discipline
>
> ¥ the specific policy or rule violated
>
> ¥ a statement about the right to respond orally or in writing.
>
> The purpose of the Skelly rule is to allow employees an opportunity to
> respond to the charges and to request a reduction or elimination of
> the discipline. It also allows for an opportunity to check out the
> evidence that management has against the employee.
