Know Your Rights

[Contract Concerns] [Representation] [Due Process] [Just Cause]

As an employee who is represented by United Educators of San Francisco,
you have rights that you would not otherwise have. Below we will
feature many of the rights from which you benefit because you're
represented by UESF. We will add to this page as needed and requested.
Please send your suggestions and questions to our webmaster.

Workers' Comp: Protect rights to use your own doctor
You have the right to use your own doctor immediately if you are
injured on the job AND if you have filed a request with Benefits and
Deduction. People who do not have such a form on record, must use the
Workers Compensation medical facilities at San Francisco General, etc.
for at least the first thirty days of treatment.

Your letter to the SFUSD should state simply that you wish your doctor
(name the person or health plan) to be your primary care provider in
the event of a work-related injury. Deliver that letter to the Benefits
and Deductions office of the SFUSD. Keep a date stamped copy for your
records.

Contract Concerns

Seniority is key in para layoff procedure
Seniority is key in layoff procedure

As a result of cuts in Consent Decree and other state and federal
funding, the District had been preparing to layoff some
paraprofessionals in the following classes: A series, R series, N
series, S series, and T series. We have been meeting with the District
to make sure there are as few layoffs as possible.

Because the District's seniority lists and employment records were
discovered to be inadequate, para layoffs are on hold. Nonetheless, we
are proceeding as though the layoff threat is real.

SFUSD para seniority based on date-of-hire in class
The State Education Code stipulates that when necessary, layoffs are
based on seniority in classification. In SFUSD, your seniority is
determined by your hiring date in a class. Examples of classes are A03
-- four hours; A03 -- five hours; R40 -- four hours or R40 -- six
hours. Each of these is a separate class.

You may belong to more than one class
Employees have seniority rights as members of these specific classes.
You may belong to more than one class if you worked and passed
probation in another classification. Layoffs always start with persons
with the lowest seniority in the class. If you are laid off, you may
have seniority in another class.

You have right to apply for vacant positions
If you are laid off, you will be eligible for unemployment. You will
also have the right to apply for any vacant positions for which you
qualify. You also have the right to return to your class for up to 39
months after being laid off if there are openings in your class.

Sick Leave: Can your administrator put restrictions on your use of sick
days or personal business days? Simply, NOT!

We do not condone sick leave abuse, but no one can require a note from
your doctor or your mother for a single day's absence. If your
administrator makes such a demand, contact your Building Rep or the
union office immediately.

Five period workday: Full-time secondary teachers teach five periods
and get one paid preparation period. Some teachers, particularly those
at small high schools and those who teach special education day
classes, have typically worked one of the five periods as counselors.
If you teach in this situation, you should see your name as the
"counselor" on the attendance sheets. If you are the counselor of
record, your schedule should include a period for counselling.

Employees' Rights to Representation in a Meeting: Weingarten

If you have reason to believe that a meeting with your administrator
will result in discipline, you have the right to have a union
representative at that meeting. You must request to have your
representative present because your administrator doesn't have to
inform you of that right.

If your administrator insists you meet without a representative, you
must attend that meeting, but do not have to answer any questions. You
cannot legally be disciplined for refusing to answer questions when you
requested a union representative but were not allowed one. In such an
instance, it is best to have put your request in writing.

This right to have a union representative present in such meetings was
established by the Supreme Court in the Weingarten case.

Public Employees' Rights to Due Process: Skelly

Public employees have due process protections on the job, as determined
by the California Supreme Court. The result of rulings in the Skelly
case, these are referred to as your Skelly rights.

Public employees are entitled to a "pre-disciplinary hearing." An
employee must be given a written notice of proposed disciplinary
action. The notice must include:
¥ a statement of the nature of the proposed discipline

¥ the effective date of the proposed discipline

¥ the reasons for the discipline

¥ the specific policy or rule violated

¥ a statement about the right to respond orally or in writing.

The purpose of the Skelly rule is to allow employees an opportunity to
respond to the charges and to request a reduction or elimination of the
discipline. It also allows for an opportunity to check out the evidence
that management has against the employee.

Seven Tests of Just Cause
Stewards' notes from University of Missouri-Columbia Labor Education
Program will help determine if management has met the seven tests of
just cause for disciplining employees.
Attention all Substitutes Ð
November 1st Deadline to Submit Paperwork
In accordance with the new contract with SFUSD, all substitutes who
qualified for Tier 2 pay in the 2005-2006 and 2006-2007 school years,
are now eligible to receive Tier 2 retroactive payment for this school
year prior to December 25, 2007.
In order to qualify for the anticipatory payment of 71 or 91 (CDP)
assignments prior to December 25, 2007 substitutes must submit proof of
qualification no later than November 1, 2007. The easiest
way to do so is to submit a letter requesting the Tier 2 pay along with
a copy of your final paycheck from the 2005-2006 and 2006-2007 school
years to the SFUSD Human Resources Substitute Office at 555 Franklin
St.
Note, if you do not have copies of those paychecks they can be obtained
from the SFUSD payroll office at 135 Van Ness Ave. If you have any
questions about the new policy please call the SFUSD Labor Relations
Department at 241-6230.
The CTA Board of Directors will award
CTA Minority Incentive Grants for
Upcoming Conferences
Minority Incentive Grants for attendance at three statewide
winter/spring conferences. Minority members are defined as belonging to
one of the following racial-ethnic groups: African American; American
Indian/Alaska Native; Hispanic; Pacific Asian American. These grants
are offered to encourage minority leadership within the Association. To
apply for these grants log in to your CTA account on www.cta.org (note:
your CTA number has been printed on your UESF membership card). There
is no need to fill out multiple applications. By completely filling out
all the information in the online application, you will assure that you
will be considered for any and all grant types for which you are
qualified. All grants include payment of the conference fee and
transportation costs.
Grants will also be offered for the summer conferences. Look for
information about the Presidents Conference and Summer Institute in
April 2008.

10-09-07 UBC MEETING
Article 22 allowing teacher to immediate suspend over rides all of
these when the teacher beliefs disruptive defiance requires immediate
response to allow other students learning not be disrupted.

TIMEOUTS WOULD BE USED AND IMPLEMENTED BY EACH INDIVIDUAL TEACHER
ACCORDING TO THEIR RESPECTIVE STUDENT POPULATIONS AND ACCORDING
IMMEDIATE NEEDS OF EACH LESSON EACH SCHOLL DAY.
Buddy room
· It was agreed that in most circumstances buddy rooms should be in
close proximity to each other to prevent hallway disruptions.
· There should be flexibility in cases where special Ed and general Ed
teacher have an agreement or in case of absence of teachers. No student
should be sent to a buddy room when teacher is absent.
· Security guards must constantly patrol classroom areas through out
school day and look in on teachersÕ classes occasionally to show a
presence.
· The administration must provide a detention room and staff it with
peer resource person, security guards, student advisors only using
counselors as a last resort. Location of buddy room must be within
building as in room 101 if possible.
· The library is not a buddy room, nor place to send disruptive
students without librarianÕs permission.

MANY FACULTY AGREED THAT SECURITY GUARDS SHOULD CONSTANTLY PATROL
HALLWAYS THROUGHOUT SCHOOL DAY TO CLEAR HALLWAYS OF STUDENTS WITHOUT
PASSES.

· If repeated incidences have occurred, a Referral should be sent to
the counseling Office.
3. PREVENTATIVE MEASURES:
· Teachers model talking calmly andquietly.
· Teachers with one foot inside and one foot outside of classroom
during passing periods.
· An adult needs to be present at the intersection in front of the
library at all passing periods.
